Food Service Permit

Any business selling food that requires temperature control must be permitted and inspected by the Arkansas Department of Health (ADH). This includes restaurants, cafés, food trucks, and bed & breakfasts. New or remodeled kitchens usually require a plan review before opening.

Certified Food Protection Manager

Arkansas requires at least one Certified Food Protection Manager (CFPM) per establishment — a manager who has passed an accredited food safety exam (like ServSafe Food Protection Manager).

Operators must comply with ADH food safety rules, including:
· Proper food storage and temperature control
· Sanitation and pest control
· Recordkeeping for food temps and cleaning logs
Failure to comply can result in fines or loss of permit.

Alcohol Service — Arkansas Specifics

Alcohol Permits

Businesses must obtain the appropriate permit from the Arkansas Alcoholic Beverage Control (ABC) to sell alcohol. Applicants must attend an ABC educational seminar about alcohol laws and responsibilities before a permit is issued.

Responsible Permittee Program (Optional but Important)

Arkansas does NOT require mandatory alcohol server/bartender training by law, and bar staff don't need a state license to serve alcohol. However, participating in the Responsible Permittee Program (e.g., state-approved alcohol service training) can mitigate fines or penalties if a violation occurs. Most employers do require alcohol server certification (e.g., ServSafe Alcohol or other third-party trainings) to satisfy insurance and liability best practices, even if the state doesn't mandate it.

Hotels and motels with food service must follow the same food permit and safety requirements as restaurants.

Human Trafficking Hotline Posting

Arkansas law requires certain establishments (including hotels/motels) to post human trafficking hotline information where employees and the public can see it. This is part of Arkansas Code §12-19-102.

Building, Fire, and ADA Codes

Hotels must meet local building codes, fire safety standards (including fire extinguishers and evacuation plans), and ADA accessibility requirements as applicable. (These are typically enforced through inspections.) — local municipality enforcement applies.

Employers must display required federal and Arkansas labor law posters (minimum wage, child labor, anti-discrimination, and other workplace notices). Posters must be in a visible employee area.
